of Use

1 · Eligibility

• You must be at least 16 years old to use Momentz.
• Facial recognition features are restricted to users 18 and over.
• You must have the legal capacity to enter into a contract in your country.
• You agree to provide accurate and up-to-date information.

2 · Accounts

Organizer account (required)

To create and host an event, you must create an organizer account. You are responsible for keeping your credentials confidential and for all activity carried out from your account.

Guest access (account optional)

• Anonymous — via a code or a QR code, with no account. Your data is deleted 10 days after the end of the event.
• With an account — a persistent profile, reusable from one event to another.

3 · Your content

What you upload

You remain the owner of all photos, videos and messages you upload to Momentz. You are responsible for them and you warrant that:

• you have the right to publish them and to grant the license described below;
• they do not infringe any copyright, trademark, image or privacy rights;
• they do not breach any law or these terms.

The license you grant us

By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display and transmit it within the service, solely to operate the event concerned and to deliver it to you and to the authorized participants of that event. This license ends when the content is deleted.

4 · Acceptable use

You agree not to:

• post content that is illegal, offensive, harassing, defamatory, sexually explicit, violent or hateful;
• post content depicting minors in an inappropriate context;
• impersonate any person;
• post content that you do not have the right to share;
• use Momentz to stalk, harass or harm anyone;
• use facial recognition or social discovery to contact people who have not enabled it;
• reverse-engineer, scrape or disrupt the service;
• access the service through automated systems without authorization;
• resell or redistribute access to Momentz.

We reserve the right to remove content, suspend an account or ban a user in the event of a breach.

5 · Facial recognition

• Your explicit consent is required before any biometric processing.
• You can withdraw that consent at any time from your profile settings.
• Social discovery (being findable by other guests) is subject to a separate consent.
• Biometric processing is entrusted to a specialised provider, under contractual safeguards.

6 · Payments

Organizer fees

Creating an event is a paid feature. The applicable price is displayed to you before any payment.

Payment processing

Payments are processed by approved third-party providers (an online payment provider for web purchases, Apple for in-app purchases on iOS). We never see or store your full card number.

Refunds

Any refund request must be sent to momentz.regaim@gmail.com within 14 days of purchase and before the event starts. Once the event has started, the service is deemed to have been provided and is no longer refundable, unless otherwise required by law. For iOS in-app purchases, refunds are handled directly by Apple.

7 · Service availability

We aim for the best possible availability but do not guarantee uninterrupted access. Momentz is provided "as is", without warranty of any kind. We are not responsible for temporary outages or for data loss caused by technical incidents.

8 · Suspension and termination

We may suspend or terminate your access, with or without notice, if we reasonably believe that you have breached these terms, violated the law or put other users at risk.

You can delete your account at any time from the app (Profile → Settings → Delete my account) or by email. Your data is then erased according to the schedule in the privacy policy.

9 · No warranty

Momentz connects organizers and guests. We are not responsible for:

• the behavior of organizers or guests during events;
• interactions between users, in person or online, including after the event;
• content posted by other users;
• losses or damages related to your use of the service, to the extent permitted by law.

10 · Limitation of liability

To the extent permitted by law, Momentz and its operators shall not be held liable for indirect, incidental, special or punitive damages, including loss of profits, loss of data or damage to reputation. Our total liability, for any claim relating to these terms, will not exceed the amount you paid to Momentz during the 12 months preceding the claim.

You agree to indemnify Momentz against any claim, damage or cost (including reasonable legal fees) arising from your breach of these terms, from your content or from misuse of the service.

11 · Governing law and jurisdiction

These terms are governed by Israeli law. Any dispute falls under the exclusive jurisdiction of the courts of Tel Aviv, Israel, except where the mandatory consumer protection laws of your country grant you additional rights.

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions remain in full force.

12 · Changes

We may modify these terms. Any material change will be announced in the app or by email. Continuing to use the service after the changes take effect constitutes acceptance.
